These Terms of Service ("Terms") govern your access to and use of AdNexus (the "Service"), operated by AdNexus ("AdNexus", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service on behalf of a publisher or organization. You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials.
You retain ownership of the quizzes, polls, surveys, images, and other content you create or upload using the Service ("Your Content"). You grant AdNexus a limited, non-exclusive license to host, display, and transmit Your Content solely as necessary to operate and provide the Service. You are responsible for ensuring Your Content does not infringe on the rights of others or violate applicable law.
The core Service is free to use. Where paid plans or add-on services are offered, applicable fees, billing terms, and cancellation policies will be presented to you before you subscribe. Fees for paid plans are non-refundable except where required by law.
Where the Service facilitates advertising placements or connects you with third-party ad networks (including Google AdX), revenue generated through those placements is paid to you directly by the applicable ad network, subject to that network's own terms. AdNexus does not guarantee any specific level of ad revenue.
You agree not to use the Service to: violate any law or regulation; infringe the intellectual property or privacy rights of others; distribute malware or engage in fraudulent, deceptive, or manipulative advertising practices; or interfere with the normal operation of the Service.
The Service, including its software, design, and branding, is owned by AdNexus and protected by intellectual property laws. Nothing in these Terms grants you any right to use AdNexus's trademarks or branding without our prior written consent, except as permitted for the operation of your own embedded quizzes where our branding may appear.
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use of the Service creates risk or harm to AdNexus, other users, or third parties.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, AdNexus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
